Faulkner County Arrest Records on ARCH

The Arkansas Criminal History (ARCH) system is the state public tool for a name-based check. The fee is $24 per run. ARCH pulls fingerprint-backed results from the ACIC database. Act 1185 of 2015 created the system, codified at Ark. Code Ann. § 12-12-1501 et seq.

ARCH returns Arkansas felony and misdemeanor convictions, open felony arrests less than three years old, and sex offender status for levels 1 through 4. The system does not return juvenile records, dismissed charges, unresolved misdemeanors, felony arrests older than three years, not guilty findings, active warrants, sealed convictions, pardoned convictions, traffic arrests, or arrests made without prints. You need first and last name, sex, and date of birth to run a search.

Under A.C.A. § 12-12-1013, any person has the right to see and challenge their own criminal history record in ACIC. Requests go to the Administrator of the ACIC Criminal History Division at 501-682-2222. Fingerprint comparison is used to confirm or clear a challenged record at no cost. The ACIC office is at 322 S. Main Street, Suite 615, Little Rock, AR 72201.

FOIA and Sealing Faulkner County Arrest Records

The Arkansas Freedom of Information Act at Ark. Code Ann. § 25-19-101 et seq. gives Arkansas citizens the right to inspect and copy public records. Faulkner County arrest records, booking sheets, jail rosters, and warrant lists are open unless an exemption applies. Agencies have three business days to respond. The Attorney General's FOIA resources include the Handbook and AG Opinions 2003-057 and 2003-183 on sealed records.

Record sealing follows the Comprehensive Criminal Record Sealing Act of 2013 at Ark. Code Ann. § 16-90-1401 et seq. You file a petition in the court where the case was heard. Many misdemeanors and some felonies qualify after the sentence ends. Serious violent felonies, sex offenses that require registration, public sexual indecency, indecent exposure, and exposing another person to HIV are not eligible. Juvenile sealing uses A.C.A. § 9-27-309.

A sealed Faulkner County arrest record is removed from public tools like ARCH and CBC. The record remains with the court and law enforcement for limited uses. Criminal history reporting itself is governed by Ark. Code Ann. § 12-12-1001 et seq., which makes ACIC the central repository and requires fingerprinting at arrest for listed offenses.
